• Styled Text to MIF Utility is licensed software.
• The Silver Edition is available upon receipt of your prepaid order. Upon payment and registration, you will receive by e-mail:
  • the application program, instructions, release notes.
• Minor releases (improvements, upgrades, and corrections, if any) are free to registered customers.
• Major releases (new features and functionalities added later), if any, will be available to registered customers at a discount.
• Payment is by PayPal or by check.

As of October 3, 2001, the Styled Text to MIF Converter application (Silver Edition) is available. Macintosh only (since SimpleText is a Macintosh editor).

Copyright: This software is protected by U.S. copyright law (Title 17 United States Code). 
Unauthorized reproduction and/or sale may result in imprisonment of up to one year 
and fines of up to $100,000 (17 USC 506). Copyright infringers may also be subject to 
civil liability.
Internationally, this software is protected under the Berne Convention. 
Permission to copy, distribute, "share," "Napsterize," or otherwise steal this product 
has not been granted by the author. 

License Agreement

Please read this license carefully before using the Product. By using the Product, you are agreeing to be bound by the terms of this license. If you do not agree to the terms of this license, promptly return the unused Product to the place where you obtained it and your money will be refunded.

Definitions

Throughout this document, the following definitions apply:

• Manufacturer is J. E. Brown, author of the Product (software).
  
• Product is Manufacturer's "Styled Text to MIF Converter" software, "Silver" Edition, in whatever form provided, including the medium (if any) and the files thereon.
• Customer is any individual person who receives and takes possession of this Product from Manufacturer.
• You means the Customer.
• Access means any and all usage of Product covered by Manufacturer's copyrights and trade-secret rights in the Product. Hence this Access includes all copying and distributing of the Product, all creation of derivative works based on the product, and all showing and sharing of the Product to and with third parties.

License

The Product software and documentation accompanying this License, whether provided on disk or on any other media, or provided by e-mail, download, or other electronic means, are licensed to you by Manufacturer. You own the medium (if any) on which the Product is recorded but Manufacturer retains title to the Product.

Permitted Uses and Restrictions

The Software contains copyrighted material and trade secrets. In order to protect them, and except as permitted by applicable law, you may not decompile, reverse engineer, or disassemble the Product.

This is a Single-User License. Under this license, you (the Customer) are permitted to possess a copy or copies of the Product, and only you may use the copy or copies governed by this license. You may not modify, rent, lease, loan, or distribute the Product, nor create derivative works based upon the Product, except as permitted under "Redistribution," below.

Backup Copy: You may make one copy of the Product in machine-readable form for backup purposes.

Reference Manuals: You may make one copy of Product's electronic documentation in printed form for reference purposes.

Working Copies: Under this license, Manufacturer waives the customary Single-CPU restriction, and consents to allow Customer to install Product on any platforms necessary for Customer's convenient use of Product, provided that Customer agrees to take all reasonable steps necessary to prevent unlicensed Access and to protect all such installed copies of Product, including:

• Customer agrees to use all security safeguards (such as passwords, metal locks and keys, and read-protection) necessary to keep Product out of the hands of potential software pirates.
• Customer agrees that all passwords used for protecting Customer's copy/copies of Product shall be passwords known only to the Customer and not shared with third parties.
• To reduce the risk of theft and piracy, Customer agrees not to store Product on any medium accessible to third parties by Hypertext Transfer Protocol (HTTP), by anonymous File-Transfer Protocol (FTP), by Digital Subscriber Line (DSL) without firewall, or by other non-password-protected communication methods.
• To further reduce the risk of piracy, Customer agrees not to habitually store Product in any unlocked, unattended desk or workstation in any unlocked, unattended room.

Customer is encouraged to refuse Access to parties who espouse anti-capitalist beliefs such as "Napster isn't theft, it's Free Speech" and "The Open-Source Movement is a societal good." These beliefs promote the one-sided attitude that sharing is a one-way obligation: that only creative people should have to share, and without payment. Such parties would have us believe that software ought to be free for the taking. I believe that work is worth money, and so, both should be shared and traded.

Redistribution of Product

In consideration of the rights granted under this License, Customer agrees that Customer shall not transmit or transfer Customer's copy of Product to third parties, nor allow it to be so transmitted or transferred. Exceptions:

• Customer may show Product's manuals to third parties.
• If you wish to redistribute the Product, please contact Manufacturer and propose a royalty or bundling agreement.

Termination

This License is effective until terminated. You may terminate this License at any time by destroying all your copies of the Product and related documentation. Your rights under this License will terminate immediately and permanently without notice from the Manufacturer if you fail to comply with any term(s) of this License. Upon termination you must destroy all your copies of the Product and related documentation.

Disclaimer of Warranty on Product Software

You (the Customer) expressly acknowledge and agree that use of the Product is at your sole risk. The Software and related documentation are provided "AS IS" and without warranty of any kind and the Manufacturer EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The Manufacturer DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE Product WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE Product WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE Product WILL BE CORRECTED.

The Manufacturer and its authorized representatives may have made statements about the Product software. Any such statements do not constitute warranties and shall not be relied on by the Customer in deciding whether to purchase this program. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY Manufacturer OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY WARRANTY.

Because of the diversity of conditions and hardware under which this Product may be used, no warranty of fitness for a particular purpose is offered. The user is advised to test the Product software thoroughly before relying on it. Any liability of seller or manufacturer will be limited exclusively to product replacement or refund of the purchase price.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Manufacturer accepts no responsibility for any technical limitations of the product. The Product software should not be relied on for solving a problem whose incorrect solution could result in injury to a person or loss of property.

Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL Manufacturer BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE Product SOFTWARE OR RELATED DOCUMENTATION, EVEN IF Manufacturer OR ITS AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. In no event shall Manufacturer's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including negligence) or otherwise) exceed the amount of twenty dollars ($20.00).

Government End Users

Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause in DFAR 52.227-7013 or the equivalent clause in FAR 52.227-14, whichever is applicable.

Controlling Law and Severability

This License shall be governed by and construed in accordance with the laws of the United States and the State of New Mexico, as applied to agreements entered into and to be performed entirely within New Mexico between New Mexico residents. If for any reason a court or arbitrator of competent jurisdiction finds any provision of this License, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.

Complete Agreement

This agreement constitutes the entire agreement between the parties with respect to this license, and supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. No amendment to or modification of this agreement will be binding unless in writing and signed by both parties. Neither Customer nor Manufacturer is relying on any representations or statements that are not included in this License Agreement.
